Swim Meet Toolkit
Please read this before using Swim Meet Toolkit to run a competition. It explains an important limit on what the Software does and on our responsibility for it. This disclaimer is incorporated into, and forms part of, the Swim Meet Toolkit End User License Agreement.
Swim Meet Toolkit helps you manage swimming competitions — building entries, seeding events, recording and scoring results, tracking records, producing reports, and publishing start lists, psych sheets, heat sheets, live results, and team scores. It is an aid to the people running the meet. It is not an official timing system, it does not replace meet officials, and it does not determine the official outcome of any race, event, or competition.
Official results, times, places, rankings, qualifications, records, and disqualifications are determined by the meet's officials and timing equipment in accordance with the rules of the applicable governing body — not by the Software.
Before you treat any output of the Software as official, post it publicly, submit it to a governing body, or rely on it for eligibility, seeding into another competition, awards, or records, you are solely responsible for independently verifying it against the official timing system and the applicable rules. This includes (without limitation) verifying times and places, heat and lane assignments, scoring and team points, age-group and qualification calculations, time-standard and record comparisons, time-conversion results, and disqualification handling.
Without limiting the above, we do not warrant that the Software will be error-free or uninterrupted; that any result, calculation, ranking, record determination, time conversion, or imported or exported file will be accurate or complete; or that the Software will work with any particular timing console, hardware, file format, web host, or third-party system.
The Software can import and export data (for example, Hy-Tek/MDB meet databases and other entry or result files) and can exchange data with timing and scoreboard systems and with web hosts you choose. We do not control those formats, systems, or services and do not guarantee compatibility, correctness of converted data, or successful transfer. Trademarks and product names referenced by the Software (including Hy-Tek, Daktronics, Colorado Time Systems, and others) belong to their respective owners; their use does not imply any affiliation with or endorsement by those owners.
Your meet data is stored on your own computer. You are responsible for maintaining your own backups. We are not responsible for any loss or corruption of meet data, however caused, including during import, export, publishing, updating, or a crash.
These limits apply to all theories of liability (contract, tort, negligence, strict liability, or otherwise) and apply even if a limited remedy is found to have failed of its essential purpose.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. To the extent those laws apply to you, some of the exclusions and limits above may not apply, and you may have additional rights. In that case, our liability is limited to the smallest amount permitted by law.
This disclaimer is governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply.
